These Terms of Service govern your use of FoundationDesk. By creating an account or using our services you agree to these terms. Please read them carefully.

The Service

FoundationDesk provides AI-powered lead capture and communication tools for contractors and tradespeople. This includes missed call text-back, lead qualifying conversations, a lead management dashboard, and related features.

Your Account

You are responsible for maintaining the security of your account and password. You must provide accurate information when creating your account. One account per business. You must be at least 18 years old to use FoundationDesk.

Subscription and Payment

• FoundationDesk is billed at $149 for your first month. After that your subscription is $197 per month billed monthly.
• Payment is due at the time of signup. Your first month begins when you create your account.
• You may cancel at any time before your next billing date and you will not be charged further.
• We offer a 30-day money back guarantee. If FoundationDesk doesn't catch you at least one job in your first 30 days we'll refund you. No questions asked.
• We reserve the right to change our pricing with 30 days notice to existing customers.

Acceptable Use

You agree to use FoundationDesk only for lawful purposes. You may not use our service to:

• Send spam or unsolicited messages
• Violate any applicable laws or regulations including SMS compliance requirements
• Collect data from homeowners without proper disclosure
• Misrepresent your business or services

SMS Compliance

By using FoundationDesk you agree to comply with all applicable SMS regulations including TCPA requirements and carrier guidelines. You are responsible for ensuring that homeowners who receive text messages through your FoundationDesk widget have provided appropriate consent. FoundationDesk provides opt-out mechanisms on all outbound messages as required by law.

Data and Privacy

Your use of FoundationDesk is also governed by our Privacy Policy. You retain ownership of your customer data. We will not sell your data or use it for purposes other than operating and improving our service.

Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We are not liable for losses resulting from service downtime or technical failures.

Limitation of Liability

FoundationDesk is not liable for any indirect, incidental, or consequential damages arising from your use of our service. Our total liability to you for any claims arising from these terms or your use of the service shall not exceed the amount you paid us in the three months preceding the claim.

Termination

You may cancel your account at any time by contacting us at [email protected]. We reserve the right to terminate accounts that violate these terms. Upon termination your access to the service will end and your data will be retained for 30 days before deletion.

Changes to These Terms

We may update these terms from time to time. We will notify you of significant changes by email. Continued use of the service after changes constitutes acceptance of the new terms.
